Livestock Microchipping Laws in Minnesota: What Every Producer Needs to Know

If you raise cattle, sheep, goats, or other livestock in Minnesota, the rules around official animal identification have changed significantly — and the distinction between a subcutaneous microchip and an RFID ear tag matters more than most producers realize. Minnesota follows both state Board of Animal Health regulations and a sweeping federal USDA rule that took effect in November 2024, making electronic identification mandatory for many classes of animals moving intrastate and interstate.

Microchipping vs. RFID Ear Tags: What Counts as Official ID in Minnesota
The first thing to understand is that “microchip” and “RFID ear tag” are not interchangeable in Minnesota law, even though both technologies use radio-frequency identification. A livestock microchip is a biocompatible capsule — roughly the size and shape of a grain of rice — that houses a small RFID chip implanted subcutaneously beneath the skin. An RFID ear tag, by contrast, is an external device clipped through the ear and readable at a distance with a handheld wand or fixed panel reader.
For most species and movement scenarios in Minnesota, ear tags must be both visually and electronically readable in order to be recognized for use as official identification for interstate movement of cattle and bison covered under the regulations. That dual requirement — visual plus electronic — is the defining feature of what the Minnesota Board of Animal Health (BAH) and USDA-APHIS consider official. A subcutaneous microchip alone does not satisfy the visual-readability requirement for cattle and bison, which is why ear tags remain the default official device for those species.
For certain other species — equines, sheep, goats, farmed cervidae, and some camelids — the rules differ. The 840-ID Official Microchip can be used in all equines, goats, sheep, alpaca, llama, elk, whitetail and other deer, etc. In those cases, an implanted chip carrying a valid 15-digit AIN beginning with the U.S. country code “840” does qualify as an approved official identification device under USDA standards, and Minnesota recognizes it accordingly.
The practical takeaway: if you raise cattle or bison, plan on RFID ear tags as your primary official ID. If you raise horses, sheep, goats, or farmed deer and elk, an implanted 840 microchip is a legitimate — and sometimes preferred — option. The Federal RFID Mandate and What It Means for Minnesota Producers
The Minnesota Board of Animal Health implemented a new USDA Animal and Plant Health Inspection Service official identification rule on electronic identification (EID) tags on November 5, 2024. USDA issued the new guideline April 26, 2024. That rule is now the baseline for how official identification works in this state.
The rule specifies that ear tags for all sexually intact cattle and bison 18 months of age or older, all dairy cattle, cattle and bison of any age used for rodeo or recreation events, and cattle or bison of any age used for shows or exhibition “must be both visually and electronically readable in order to be recognized for use as official identification.” Current EID technology meeting that standard is RFID.
This means visual-only tags like the NUES 9 (metal or plastic) tags will no longer be counted as official unless they were applied to the animal before the November 5, 2024, deadline. If you still have animals carrying older metal or plastic NUES tags applied before that date, those tags remain valid for the lifetime of those animals. Any new tagging, however, must use RFID-capable devices.
One important clarification from the BAH: the rule changes what counts as official ID, not when official ID is needed. The rules regarding what needs to be identified when are not changing. Which Livestock Can Use a Microchip as Official Identification in Minnesota

For other species, the picture is different.
Equines (horses, mules, donkeys): Implanted 840 microchips are an accepted official identification device for horses in Minnesota. Horses, deer, elk, alpaca, llama, and other livestock must have a Premises Identification Number to use the 840 microchip. Sheep and goats: The 840-ID Microchip is an officially approved microchip, and the FDA’s Center for Veterinary Medicine also approved the 840-ID Microchip for use in sheep and goats. When using an electronic identification device (EID) for sheep or goats in Minnesota, sheep or goats must be accompanied by an electronic reader during movement. Additionally, goats and sheep must have both a Premises ID Number and a Flock (Scrapie) ID Number before ordering or using 840 microchips.
Farmed cervidae (deer, elk, and related species): Official ear tags placed in farmed cervidae after January 1, 2018, must adhere to either the National Uniform Ear-tagging System or the Animal Identification Number system. USDA-approved injectable 840 transponders for deer and elk — such as the AVID and EZID injectable transponders — qualify under the AIN system. Swine: Swine identification in Minnesota does not commonly rely on implanted microchips for official purposes. A premise-of-origin ear tag identifies a sow or boar to the premises they were kept immediately prior to entering slaughter channels. When a Microchip Qualifies for Interstate Movement in Minnesota
Moving livestock across state lines adds a layer of federal requirements on top of Minnesota’s own rules. Any livestock moving interstate must also meet requirements of USDA and the state of destination. At minimum, this requires a Certificate of Veterinary Inspection (CVI) issued by an accredited veterinarian. For cattle and bison, a subcutaneous microchip does not substitute for the required RFID ear tag under the November 2024 federal rule. There are limited exceptions to the interstate ear tag requirement. Exceptions when moving cattle or bison across state lines include: having a commuter herd or official agreements; moving animals through another state back to the original state; moving animals directly to an approved tagging site and giving official identification back tags prior to commingling; moving animals directly to slaughter; and moving animals directly to no more than one approved livestock facility market, then directly to slaughter with a back tag.

- UHF RFID tags: Also approved by APHIS for official use, though LF remains dominant for injectable implants in livestock.
- 840-prefix AIN devices: The Animal Identification Management System (AIMS) is used to administer official animal identification numbers and devices. All distribution records for AIN devices are maintained on AIMS.
Placement varies by species and manufacturer protocol. For sheep and goats, the chip is typically implanted subcutaneously in the mid-neck or behind the ear, following USDA National Scrapie Eradication Program standards. For equines, the standard site is the nuchal ligament in the left side of the neck, per most breed registry and USDA protocols. For farmed cervidae, placement follows USDA-approved injectable transponder guidelines — the AVID and EZID injectable transponders approved for deer and elk specify subcutaneous placement per the APHIS AIN device list.
Always scan the microchip before insertion to confirm it is working. Insertion is essentially a subcutaneous injection using a large-gauge needle. After insertion, brush or rub the area to confirm the chip is not on the surface of the skin, then rescan to verify it is working in the embedded location. Anti-migration coatings, such as the Bio-Bond process used by some manufacturers, help prevent chips from shifting away from the implant site over time — an important consideration for animals that will be scanned repeatedly across their lives.

Registering a Livestock Microchip in Minnesota
Implanting a chip is only half the job. For the chip to function as official identification, the number must be tied to a registered premises and recorded in the appropriate state and federal systems. Minnesota uses a Premises Identification Number (PIN) as the anchor for all official livestock ID records.
Here is the registration process you need to follow:
- Register your premises with the Minnesota Board of Animal Health. Register your premises where livestock are kept through the BAH at bah.state.mn.us/premises-and-livestock-registration. Your PIN is required before any official 840 device — chip or ear tag — can be ordered or applied.
- Obtain a Flock/Scrapie ID if you raise sheep or goats. Goats and sheep must have both a Premises ID Number and a Flock (Scrapie) ID Number. To get your Scrapie Flock ID, call 866-873-2824.
- Order USDA-approved 840 microchips from an approved manufacturer. Approved manufacturers include AVID (marketed through EZid Livestock Identification), Microchip ID Systems, and Destron Fearing, among others listed on the APHIS AIN device list. 840 microchip orders cannot ship until Flock and/or Premises IDs are verified.
- Record the chip application. As animals receive identification, there must be a record to trace each animal. Record the tag number, animal species, sex, age, type, date applied, and name and address where the identification was administered.
- Maintain records for the required retention period. Records must be retained for five years for cattle transactions under Minnesota Rule 1721.0140. For farmed cervidae, records must be maintained for at least ten years.
Veterinarians may distribute official identification ear tags — and by extension, official microchip devices — to their clients for application to Minnesota livestock. When official ear tags are distributed, records must be kept, including the date of distribution, the characters on or contained within each ear tag distributed, and the name and address of the premises where the livestock to be identified reside.

In a legal or law enforcement context, a chip number alone does not establish ownership in Minnesota — you also need documentation linking that chip number to your premises and your name. The records you keep as part of the official ID registration process (the date of application, your premises address, and the species data) are what convert a chip scan into a defensible ownership claim. Minnesota does not have a single statewide livestock chip registry analogous to a pet microchip database.
